Terms of Service
Agreement
By creating a Morning Kept account and using Tuned or Handled, you agree to these terms. If you do not agree, do not use the service.
Morning Kept LLC is a Connecticut limited liability company. References to "Morning Kept," "we," "us," or "our" refer to Morning Kept LLC. References to "you" or "your" refer to the subscriber.
The Service
Morning Kept operates two products:
Tuned — an AI-powered personal fitness coaching application that generates personalized daily workout recommendations and readiness assessments based on your profile, session history, and wearable device data where connected.
Handled — an AI-powered household meal planning application that generates personalized weekly dinner plans based on your household's preferences, dietary needs, and cooking history.
Both products are delivered as web applications accessible from any modern browser and installable as Progressive Web Apps on iPhone and Android home screens.
Subscriptions and Payment

Payment
Payment is collected upfront before onboarding begins. We accept payment through Stripe. By subscribing, you authorize Morning Kept to charge your payment method on a recurring basis at the applicable subscription rate.
No Free Trial
There is no free trial. Payment is required before accessing the product.
Annual Subscriptions
Annual subscriptions are offered at a discount equivalent to two months free — pay for 10 months, receive 12. Annual subscriptions do not automatically refund for unused months if cancelled mid-term. You may cancel an annual subscription before its renewal date to prevent automatic renewal.
Monthly Subscriptions
Monthly subscriptions renew automatically at the end of each billing period. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refund is issued for the unused portion of the current period.
30-Day Satisfaction Guarantee
If you are not satisfied with Morning Kept after your first 30 days of use, contact us at alan@morningkept.com within 30 days of your original purchase date for a full refund. This guarantee applies once per subscriber. It does not apply to renewals after the initial 30-day period.
Not Medical or Dietary Advice
Tuned and Handled do not provide medical advice, dietary advice, or professional health guidance of any kind.
Fitness recommendations from Tuned are not a substitute for a licensed personal trainer, physical therapist, or physician. Before beginning any new exercise program, you should consult with a qualified healthcare professional, particularly if you have any existing medical conditions, injuries, or physical limitations.
Meal recommendations from Handled are not a substitute for a registered dietitian, nutritionist, or physician. If you have a medical condition that affects your diet, consult a qualified healthcare professional before relying on Handled's recommendations.
Morning Kept is not responsible for any injury, illness, or adverse outcome resulting from following recommendations generated by Tuned or Handled.
Your Account
Creating an Account
You must provide a valid email address to create a Morning Kept account. You are responsible for maintaining the security of your account. Do not share your PIN or authentication credentials with anyone.
Account Limits
Each Tuned subscription covers one individual. Each Handled subscription covers one household of up to two members. Sharing an account beyond these limits is not permitted.
Second Household Member (Handled)
A second household member may access Handled under a household subscription. The second member creates their own authenticated account linked to the household. The primary subscriber is responsible for ensuring the second member agrees to these terms.
Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to access another user's account or data
- Attempt to reverse engineer, decompile, or extract the product's AI prompts, recommendation logic, or proprietary systems
- Use automated tools to scrape, crawl, or extract data from the service
- Resell or sublicense access to the service
- Use the service in any way that could damage, disable, or impair Morning Kept's infrastructure
Intellectual Property
All content, design, code, AI prompts, recommendation logic, and proprietary systems within Morning Kept's products are the intellectual property of Morning Kept LLC. These terms do not grant you any rights to Morning Kept's intellectual property beyond the right to use the service as described.
Your personal data belongs to you. Morning Kept uses it solely to operate the service. You may request an export or deletion of your data at any time by contacting alan@morningkept.com.
Wearable Device Integrations
Tuned integrates with third-party wearable devices through their official APIs. Morning Kept is not affiliated with or endorsed by any wearable device manufacturer. Availability of device integrations may change based on third-party API access and policies. Morning Kept is not responsible for interruptions to wearable integrations caused by third-party API changes.
AI-Generated Content
Recommendations generated by Tuned and Handled are produced by an AI system and are based on the information you provide. They are personalized but not infallible. Morning Kept does not guarantee that AI-generated recommendations will achieve any particular fitness or health outcome.
Limitation of Liability
To the maximum extent permitted by applicable law, Morning Kept LLC's total liability to you for any claim arising from or related to the service is limited to the amount you paid to Morning Kept in the 12 months preceding the claim.
Morning Kept LLC is not liable for indirect, incidental, special, or consequential damages including lost profits, lost data, or personal injury arising from your use of the service. Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be limited by law.
Termination
Morning Kept may suspend or terminate your account if you violate these terms. You may cancel your subscription at any time through account settings or by contacting alan@morningkept.com.
Upon termination, your access to the service ends at the close of your current billing period. Your data will be retained for 30 days following termination before deletion, during which time you may request an export.
Changes to the Service
Morning Kept reserves the right to modify, suspend, or discontinue any aspect of the service with reasonable notice. We will notify subscribers of material changes by email. Continued use of the service after notice of changes constitutes acceptance.
Changes to These Terms
We may update these terms as the service develops. Material changes will be communicated by email or in-app notice. The effective date at the top of these terms reflects when they were last updated.
Governing Law
These terms are governed by the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the service will be resolved in the courts of Connecticut.
Entire Agreement
These terms, together with the Morning Kept Privacy Policy, constitute the entire agreement between you and Morning Kept LLC regarding the service.
